General Terms and Conditions Vayuna

Welcome! These are the general terms and conditions (the "Conditions") of Campania-Investments B.V., trading under the name (Cellier de) Vayuna ("Vayuna"). Vayuna inter alia sells champagne and related merchandise (the "Products"). For more information, refer to: https://vayunachampagne.com (the "Webshop").

We recommend that these Conditions are read carefully: they apply to all offers, agreements and other dealings between Vayuna and you as a customer (the "Customer"). Vayuna offers its Products on the condition that you accept these Conditions. We may amend these Conditions. You agree that the latest version of these Conditions will always apply to the Agreement. The latest version of the Conditions is available on the Webshop.

Definitions

1.1 Vayuna: Campania-Investments B.V. trading under the name (Cellier de) Vayuna, a company with limited liability incorporated under Dutch law, having its statutory seat in Amsterdam and its registered office in Breukelen (3621 ZA) at De Corridor 7, and registered in the trade register of the Dutch Chamber of Commerce under number 84698381.

1.2 Agreement: the agreement established between Vayuna and the Customer at the time that Vayuna accepts an Order, including any amendment or supplement thereto.

1.3 Customer: you, the natural person who orders Products from Vayuna and enters into an Agreement with Vayuna or negotiates with Vayuna to conclude an Agreement.

1.4 Parties: Vayuna and the Customer, together.

1.5 Products: Products from Vayuna, which can be ordered via the Webshop (the "Order").

Offer

2.1 In the Webshop we offer an exclusive champagne with a variety of related merchandise. See the Webshop for the current range of Products.

2.2 The offer is without obligation. Vayuna can change and adapt the offer at any time.

2.3 All images, specifications and details in the offer are indicative and cannot be a reason for compensation of damages or termination of the Agreement

Order

3.1 The Customer can place an Order via the Webshop. After placing the Order, the Customer shall receive an Order confirmation and a separate e-mail with the relevant tracking details.

3.2 However, to place an Order and for us to fulfil the shipment of the Order, you must provide us with your personal data. This personal data must be entered truthfully, and it must be up to date. We ensure proper protection of your personal data; please see our Privacy Notice.

Account

4.1 You can register on the Webshop by creating an account, but this is not obligatory. Creating an account, however, has several advantages, being: checking out faster, keeping more than one address, and tracking Orders. For this purpose, you must provide us with your personal data. This personal data must be entered truthfully, and it must be up to date.

4.2 We ensure proper protection of your personal data; refer to our Privacy Notice on the Webshop. Use a strong password for your account and never give your password to others. You are personally responsible for any misuse of your account (for example: if someone else places an order with us using your password).

Establishment of Agreement

5.1 The Agreement between you and Vayuna is established after an Order has been accepted by Vayuna.

5.2 Vayuna reserves the right, without giving any reasons, not to accept an Order or only to accept it on the condition that the shipment is sent cash on delivery or after prepayment.

Sale of alcoholic Products

6.1 By placing an Order for Products that contain alcohol, you need to confirm you are of the legal drinking age in your country or jurisdiction. We will not and cannot sell alcohol to people under the legal drinking age.

6.2 We have implemented various different age checks in the ordering process in the Webshop. To ensure that our Products are handed over to an adult only (thus meeting the requirements of the laws and regulations) the delivery person can enquire about the recipient’s age and request identification.

Delivery

7.1 At the time that an Agreement is concluded, Vayuna will ensure delivery of the Order in the manner as set out on the Webshop.

7.2 Each Product is shipped and delivered by our fulfilment partner MoreStorage B.V., located at Goudstraat 65 (2718 RD) Zoetermeer, and its selected logistical providers. We do not store or distribute any of the Products advertised on this website.

7.3 Delivery takes place while stocks last.

7.4 We deliver the Order to the address you have specified when placing the Order. You can no longer change the address once we have sent the Order. Vayuna only ships Orders to Customers within Europe.

7.5 Upon delivery of Products that contain alcohol, a signature and age verification may be required to confirm that the Customer is of legal drinking age. If the Customer is unable to provide age verification, the delivery may be refused, and the Customer may be responsible for any associated costs.

7.6 Vayuna will use its best efforts to deliver the Order in such way the quality of the Order is secured.

7.7 We will do our utmost to deliver the Order within the time-limit stated on the Webshop. However, all time-limits stated on the Webshop are indicative. No rights can be derived from the aforesaid time-limits.

7.8 We guarantee that you will receive the Order at the latest within thirty (30) days after confirmation of the Order. Should this inadvertently not be the case, then you may request us to (a) immediately repay the amount that you paid for the Product, or (b) send a replacement Product (of equal value).

Return and withdrawal

8.1  You may always return the Product within fourteen (14) days after receipt. You can do so by using the return form on the Webshop or by sending an email to yourmoment@vayunachampagne.com.

8.2 After receipt of confirmation from us, the Product must be returned within fourteen (14) days. Shipping is at your own risk and costs for return shipments are for your own account.

8.3 After receipt and inspection of the Product, the purchase amount will be refunded in full within fourteen (14) days.

8.4 During the period of fourteen (14) days in which you may decide whether to keep the Product, the Product and packaging must be handled with care. The Product may only be unpacked and used as necessary to determine whether you want to keep it, in a manner that would be appropriate in a shop.

8.5 Products that contain alcohol may only be returned if they are damaged or spoiled upon delivery.

8.6 Vayuna will not accept returns or offer refunds for alcoholic Products that have been opened or partially consumed, except in cases where they are defective or damaged.

Prices and payment

9.1 The Product prices stated in the Webshop are in Euros, including VAT and excluding shipping costs.

Intellectual property rights

All intellectual property rights (such as: copyrights, word trademarks, figurative trademarks, tradenames) vesting in the Products, packaging, Webshop, texts, photographs, images and other (promotional) materials are exclusively owned by Vayuna (or are managed by us with permission of the entitled party). Privacy

We respect your privacy. Vayuna is compliant with the General Data Protection Regulation and other relevant privacy legislation and regulations. If use is made of the Webshop, such as placing an Order, certain personal data must be processed. Our Privacy Notice explains which personal data we collect and what we do with it.

Complaints procedure

12.1 Please contact us if you have any complaints about the execution of the Agreement. Send Your comprehensively described complaint as soon as possible to yourmoment@vayunachampagne.com.

12.2 Your complaint will be dealt with as soon as possible, yet at the latest within fourteen (14) days after receipt thereof. Should it take longer to finalize the complaint, a confirmation of your complaint will be sent within fourteen (14) days, to inform you when a substantive response can be expected.

12.3 If Vayuna and the Customer are unable to mutually resolve the complaint within four (4) weeks, the Customer may report the complaint via the European ODR platform.

Queries, remarks and suggestions

13.1 Vayuna wants to offer all its Customers an optimum service. For any queries, remarks or suggestions, please contact us using the contact details below or via the contact form on the Webshop. We will endeavor to respond to messages within five (5) working days.

Miscellaneous

14.1 If Vayuna does not enforce parts of these Conditions and/or the Agreement, this cannot be regarded as a waiver of the right to enforce this at a later stage against the Customer.

14.2 The Customer cannot transfer his rights and obligations under these Conditions and/or the Agreement to third parties.

14.3 Vayuna can assign and/or transfer all rights and obligations under these Conditions and/or the Agreement to a third party, without consent from the Customer being required.

14.4 If any provision of these Conditions and/or the Agreement is deemed unlawful, void, voidable or otherwise unenforceable, this does not affect the validity and enforceability of the remaining provisions of these Conditions and/or the Agreement. The unlawful, void, voidable or otherwise unenforceable part shall be deemed replaced by a valid and enforceable provision that closely achieves the aim and scope of the replaced provision.

Applicable law and competent court

15.1 These Conditions and all Agreements between Vayuna and the Customer are exclusively governed by Dutch law.

15.2 Unless contrary to mandatory law, all disputes and claims arising out of or in connection with these Conditions and/or the Agreements must be submitted to the competent court in Amsterdam.
